RELEASE OF LIABILITY

I.      RELEASE AND WAIVER.  In consideration of the terms and conditions set forth herein, the Releasor(s) hereby fully  and forever releases, waives, and discharges Wild Roots LLC, along with it’s affiliates, employees, agents, heirs, successors, owners individually, and assigns, from any and all claims, demands, damages, actions , or causes of action, whether known or unknown, arising out of or relating to any injury, loss, or damage that may occur as a result of any activity including but not limited to residing on the property, fishing, hiking, swimming, kayaking, biking or tubing, as well as consuming food from or on the property at the address 7135 Kalama River Rd, Kalama, WA 98625 on (“Liability Event”), before or after the date of this Release.

II.      ASSUMPTION OF RISK.   The Releasor(s) understand and acknowledge that there are inherent risks associated with the Liability Event.  The Releasor(s) assume full responsibility for any injuries, accidents, wildlife encounters, defective equipment, property damages, disability, death, or losses that may be sustained as a result of participating in the Liability Event.

III.       INDEMNIFICATION.  The Releasor(s) agrees to indemnify and hold harmless the Wild Roots LLC from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees arising out of or resulting from the Releasor’s participation in the Liability Event.

IV.      NO ADMISSION OF LIABILITY.  This release is not an admission of liability by Wild Roots LLC.  Wild Roots LLC denies and continues to deny any wrongdoing or liability.

V.      SIGNATURES. By signing below, the Releasor(s) that they have read and understand this Release and agree to be bound by its terms.

VI.  PAYMENT. As a part of this release, the parties agree to no payment by the Wild Roots LLC to the Releasor.

VII.    GOVERNING LAW.  This Release shall be governed and construed in accordance with the laws and the state of Washington.

VIII.     ENTIRE AGREEMENT. This release constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings or agreements, whether written or oral, regarding such subject matter.

IX.    SEVERABILITY. If any provision of this Release is held to be invalid or unenforceable, the remaining provisions shall continue to be valid and enforceable to the furthest extent permitted by the law.

X.   SIGNATURES. By signing below, the Releasor(s) that they have read and understand this Release and agree to be bound by its terms.

BINDING EFFECT.  This release shall be binding upon and inure to the benefit of the parties and their respective heirs, legal representatives, successors, insurance companies, and agents, and assigns. I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN IT OF MY OWN FREE WILL. WHEN REGISTERING ONLINE, MY ONLINE SIGNATURE SHALL SUBSTITUTE FOR AND HAVE THE SAME LEGAL EFFECT AS IF I HAD SIGNED A WAIVER AND RELEASE AGREEMENT.
